2. Description of Service

LoomaScale provides an AI-powered media buying platform that automates digital advertising campaign management. The Service includes automated creative testing, audience discovery, budget optimization, competitor intelligence, and AI-generated ad creatives. The Service is designed to work with supported advertising platforms including Meta, Google Ads, and TikTok Ads.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

Access to the Service requires a paid subscription. By subscribing to a plan, you agree to pay the applicable fees as described on our pricing page. Subscriptions are billed based on your chosen billing cycle (monthly, quarterly, or yearly) and will automatically renew unless cancelled before the next billing period.

• Refunds are provided at our discretion within 14 days of initial purchase
• We reserve the right to change pricing with 30 days' notice
• Failed payments may result in suspension of access to the Service

5. Ad Account Access

By connecting your advertising accounts to LoomaScale, you grant us permission to access, read, and modify your campaigns, ad sets, ads, and related data through official platform APIs. This access is necessary for the Service to function. You represent that you have the authority to grant this access for any accounts you connect. You may revoke access at any time by disconnecting your accounts.

6. User Responsibilities

You agree to:

• Comply with all applicable laws and regulations regarding digital advertising
• Ensure your ad content meets the policies of connected advertising platforms
• Not use the Service for any illegal, fraudulent, or harmful purpose
• Not attempt to reverse-engineer, decompile, or disassemble the Service
• Not share your account credentials with unauthorized parties
• Maintain compliance with advertising platform terms of service

7. Limitation of Liability

LoomaScale provides AI-powered recommendations and automation, but does not guarantee specific advertising results, including but not limited to return on ad spend (ROAS), cost per acquisition (CPA), or conversion rates. Advertising performance depends on many factors outside our control, including market conditions, product quality, and platform algorithm changes. To the maximum extent permitted by law, LoomaScale shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by LoomaScale and is protected by international copyright, trademark, and other intellectual property laws. AI-generated creative assets produced by the Service for your campaigns are licensed to you for use in your advertising.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of the Service after any modifications constitutes acceptance of the revised Terms.
